The general terms and conditions defined below apply between the tenant of the holiday accommodation (tenant) and the landlord.

MOBILE HOME RESERVATION

Reservation of the mobile home is possible in several ways – via e-mail, telephone number, through the reservation form on the website (currently not yet active) and through intermediaries (Booking, etc.). The reservation process begins once the tenant receives a confirmation e-mail with all reservation details and a valid offer to the provided e-mail address. The contract is concluded and the reservation confirmed only once the deposit or the full amount stated in the offer has been paid. If payment is not received, the reservation is considered not to have been made.

Reservation of the mobile home is possible for a minimum of 2 nights during the low season and a minimum of 3 nights during the high season. In the case of a reservation for 2/3 nights, an additional charge of 30% of the nightly rate applies.

CHANGES OF DATA

The tenant is obliged to provide accurate and truthful information. Changes to the information regarding persons staying in the accommodation are possible up to 4 days before arrival at the campsite. If changes to reservation details regarding guests are made later, an additional fee of 25 EUR applies. Cancellation conditions apply to all other changes.

MINIMUM AGE

The minimum age for the tenant is over 18 years. The tenant is responsible for the accuracy of their rental information. Parents are responsible for their children.

USE OF THE MOBILE HOME

The mobile home may only be used by persons listed in the reservation and registered upon arrival at the BIG BERRY resort reception. The accommodation unit also has a maximum number of persons allowed to stay at one time. SUBLETTING the accommodation to third parties is prohibited (the tenant may not rent the mobile home to third parties).

RENTAL PRICE

The rental price includes the rental of the mobile home with all accompanying equipment, bed linen and towels. Pets are not included in the price. Tourist tax and registration fee are not included in the price and are payable at the resort reception (according to the valid BIG BERRY resort price list). The valid price list is published on the website magnoliahouse.si. VAT is not charged in accordance with Paragraph 1 of Article 94 of the VAT Act.

PAYMENT TERMS

Within 14 days after making the reservation, a deposit in the amount of 30% of the reservation value must be paid. If the payment is not made, we reserve the right to cancel the reservation. The remaining amount must be paid no later than 10 days before arrival. For short-term reservations, the full amount must be paid immediately after the confirmation and pro forma invoice have been sent. The reservation is fully confirmed once the full payment has been received from the tenant.

WITHDRAWAL FROM THE CONTRACT BY THE LANDLORD

If the mobile home is not available for rental through no fault of the landlord and for any other reason (damage caused, storm, fault of the previous tenant, etc.), the landlord has the option to replace the rented accommodation with another accommodation of the same size. If replacement is not possible, the landlord may withdraw from the contract. In this case, all advance payments will be refunded to the tenant. The tenant may not claim compensation from the landlord.

CANCELLATION BY THE TENANT

The tenant may cancel their arrival under the following conditions:

The reservation is valid until 24:00 on the day of arrival.

The reservation may be cancelled in writing, online or by e-mail no later than 0 days before arrival. The cancellation conditions are stated in the confirmation letter sent to the tenant by the landlord.

If the guest does not check in to the mobile home, 100% of the reservation amount will be charged.

Free cancellation applies in case of cancellation up to 14 days before arrival.*

In case of cancellation 13–0 days before arrival, 100.00% of the reservation amount will be charged.

*This does not apply to reservations made at the “non-refundable rate”. In this case, 100% of the reservation amount is payable regardless of the cancellation date.

CHECK-IN / CHECK-OUT

Check-in is possible from 15:00 local time. Check-out is possible until 10:00 local time. Check-in and check-out take place at the resort reception. The accommodation key is also received at the resort reception. Check-in is carried out by presenting a personal identification document (identity card, passport, newborns with a birth certificate).

HANDOVER OF THE PROPERTY

The tenant takes over a clean and tidy mobile home with all accompanying equipment listed in the inventory list. During the rental period, the tenant must take care of the property and use it in accordance with the principle of a “good caretaker”. When leaving the property, the tenant must ensure that it is protected against storms (windows closed, etc.). The mobile home is cleaned before arrival, while the replacement of towels and bed linen during the stay is possible only as a paid service. Intermediate cleaning of the mobile home is also possible at an additional charge and is charged according to the valid price list.

RETURN OF THE RENTED PROPERTY

Upon departure, the tenant must ensure that the property is protected against storms (windows closed, etc.). Rubbish must be removed from the property, the refrigerator emptied, dishes washed and put back in their place, the property swept, and the chairs on the terrace arranged as they were upon arrival. The key must be returned to the resort reception. The tenant is responsible for any intentionally caused damage and must pay compensation for it (for example: intentional damage to furniture, removal of inventory, burns on furniture, curtains, etc.).

RESORT HOUSE RULES

The tenant is contractually bound by the resort house rules, which are published at the resort reception. Violation of the resort house rules may lead to sanctions by the owner of the BIG BERRY resort.

The landlord is not responsible for matters affecting the resort over which the landlord has no influence. In such cases, no claims may be made against the landlord. The landlord also cannot guarantee an exact parking space next to the mobile home, but one parking space for a passenger vehicle is guaranteed in the marked parking areas within the resort. Infrastructure fluctuations, fluctuations in the electricity and water supply, and fluctuations in the Wi-Fi signal may occur, over which the landlord has no influence and for which the landlord is not responsible. The tenant agrees to follow the instructions of the resort staff in the event of a possible evacuation.

INSURANCE

The landlord takes out partial comprehensive insurance for the rental. The tenant is responsible up to the deductible amount (up to EUR 360) for any damage caused by the tenant.

ACCIDENT

In the event of any accident, the owner and the resort reception must be notified immediately. The names of witnesses must be provided and the event described.

DEFECTS AND COMPLAINTS

All defects and malfunctions must be reported immediately to the resort reception, and maintenance staff must be allowed to enter the mobile home to repair the defects. Complaints must be submitted in writing to the landlord at the e-mail address: anja@magnoliahouse.si. Facilities and activities in the resort may be limited or completely closed, especially in the pre-season and post-season period. The landlord is therefore not responsible for this.

LOST AND FORGOTTEN ITEMS, DAMAGES

The landlord is not responsible for items forgotten by the tenant. If the items are found and the tenant contacts the landlord, they may be collected at an agreed time. Any costs arising from this are borne by the tenant. The landlord is not responsible for lost, stolen or damaged items belonging to the guest, nor for accidents or damage to guests’ property within the resort caused by force majeure (flood, fire, earthquake, storm) or by third parties. The landlord is also not responsible for vehicles parked inside or outside the resort.

PETS

Pets are allowed. The additional charge per day for one is 10 €.

SMOKING

Smoking is not permitted inside the mobile home.

DATA PROTECTION

The customer agrees that the landlord may store their personal data (guest name and surname, address, date of birth, telephone number, e-mail address, arrival and departure date, payment method and any additional data important for the execution of the transaction) for reservation purposes where necessary. In the event of cancellation, we must retain your data for the purpose of proving the reservation or its cancellation.

Upon arrival at the resort, guests are registered at the resort reception, where personal data is entered into the guest register or registration system. The collected data (which may change according to changes in legislation) includes: name and surname, place, country and date of birth, nationality, number and type of identification document, address, date and time of arrival and departure from the accommodation, gender, basis for exemption or reduction of tourist tax payment, and telephone number for ramp access purposes.

The customer has the right at any time to request information about their stored personal data and request its deletion. Requests for information must be submitted in writing to anja@magnoliahouse.si. Personal data is protected in accordance with data protection regulations and will not be disclosed to third parties unless required by law.

CHANGES TO THE GENERAL TERMS AND CONDITIONS

The landlord reserves the right to make any changes, partially or entirely, to any part of the general terms and conditions without prior notice and without limitation. Changes take effect from the moment they are published on the website www.magnoliahouse.si.
